Terms of Service

These Terms of Service govern your use of NEXA48 services, including our 48-Hour Business Website package and any other web design or development services we provide. By engaging NEXA48 for services, making a payment, or submitting project details, you agree to these terms. NEXA48 reserves the right to update these terms at any time. Continued use of our services following any changes constitutes acceptance of the updated terms.

NEXA48 provides web design and development services including but not limited to: • 48-Hour Business Website package (up to 5 pages, as described on our website) • Custom website design and development • E-commerce and booking platform development • Website redesign and modernization • NEXA48 Care (ongoing hosting and maintenance) The specific deliverables for each project are confirmed at the time of engagement. NEXA48 reserves the right to decline any project at its discretion.

Standard 48-Hour Business Website Package: • 50% deposit (KSh 12,500) is required to begin work • The remaining 50% (KSh 12,500) is due upon project completion and client approval • The 48-hour production window begins after payment of the deposit AND receipt of all required project materials Payment Methods: • M-Pesa, Visa, Mastercard via our secure third-party payment provider • NEXA48 does not collect or store card details directly Late Payment: • Work will not commence without the agreed deposit • Delivery of the completed website is conditional on receipt of the balance payment All prices are in Kenyan Shillings (KSh) unless otherwise stated.

The 48-hour delivery target for the standard package applies under the following conditions: • The deposit has been received and cleared • All required content, assets and materials have been provided by the client • Project scope has been confirmed The 48-hour clock starts when all three conditions above are met. NEXA48 will endeavour to meet the 48-hour target but does not guarantee delivery within this timeframe if client materials are incomplete or delayed. Custom and complex projects have separate agreed timelines.

The standard 48-Hour Business Website package includes two (2) rounds of revisions. Revisions are defined as reasonable adjustments to the agreed design and content — including text changes, colour adjustments, layout modifications and minor content additions. Revisions do not include: • Significant scope changes or additional pages • Complete redesigns after approval of the initial concept • New features not included in the original scope Additional revision rounds or scope changes are quoted separately.

Upon receipt of full payment, the client receives full ownership of the completed website design and code. NEXA48 retains the right to: • Display the completed project in its portfolio (as a concept redesign if the client prefers anonymity) • Reference the project type and industry in marketing materials The client is responsible for ensuring they have the rights to all content, images, logos and materials provided to NEXA48 for use in the project. Third-party components, plugins and frameworks used in development may be subject to their own licensing terms.

The client is responsible for: • Providing accurate and complete business information, content and assets • Reviewing and providing feedback within agreed timeframes • Ensuring they have the right to use all provided materials (logos, images, text) • Providing access to existing hosting, domain or third-party accounts as needed • Timely payment in accordance with agreed terms Delays caused by the client's failure to provide required materials or feedback may affect delivery timelines.

NEXA48 provides services on an "as is" basis. To the fullest extent permitted by law: • NEXA48 does not guarantee specific business outcomes, revenue increases, search engine rankings or conversion rates resulting from use of our services • NEXA48's liability in connection with any project is limited to the fees paid for that specific project • NEXA48 is not liable for indirect, consequential or incidental damages Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Either party may terminate the engagement with written notice. In the event of termination: • Work completed up to the point of termination will be invoiced proportionally • The deposit is non-refundable once work has commenced • If NEXA48 terminates the engagement without cause, a pro-rated refund of the deposit may be issued at NEXA48's discretion Completed and approved work is non-refundable.

These Terms of Service are governed by the laws of Kenya. Any disputes arising from these terms or our services shall be subject to the jurisdiction of Kenyan courts. For questions about these terms, contact us at hello@nexa48.com.
